Sure, the judge can award the landlord damages, back rent and court costs, but if the tenant quits their job and skips town, they can't garnish their wages and may spend more in attorney fees trying to get blood from a turnip.

Best option for heat retention and leveling is always a plywood subfloor on 2x4s or thinner sleepers- this would make leveling a breeze, but you do sacrifice some ceiling height.
