There are fear mongers on this webpage and I can tell you that the threat of prison will not deter me from taking what ever action I feel is necessary!

I am REALLY leaning towards getting away from HOA's altogether - too aggravating and they are obviously a significant threat to our business.  

Bulging walls with out any signs of remediation, jacks that are threating to kick out.

If no resolution within that time period then file for the eviction.What happens all too  often (and why some tenants deliberately choose private landlords over bigger management companies) is that individual landlords may be clueless on the statutes in their own state, may buy sob stories, may not wish to be the "bad guys" or may be intimidated by the useless threats of being "sued" by a deadbeat tenant, etc.. 

However, in the event of a lawsuit you would lose some or all of your statutory defences, and might even be successfully sued for treble damages under the statute of fraud.Utilizing a structure of purchase contract assignment would somewhat disguise the brokering activity, and lessen the threat of a lawsuit.  

I think I'm going to go with the 20% increase threat option to start the relationship with the new tenants off on the right foot.

LOL.... letters and e mails are just idol threats.. don't lose any sleep over it unless.. you actually think you did something wrong.

Don't let the threat of a lawsuit scare you.

Fix the dryer setup while you're at it.Never bow down to threats of being sued.
