I mean, you can still file for eviction if there's nonpayment, but if on month-to-month, you can file for eviction *and* give them notice to vacate.... a two-prong attack on getting control (and hopefully some money) back.So, if they haven't paid, file for eviction immediately.

Oral month to month contracts are perfectly valid, and transfer along with the property. in fact, this is nearly an ideal situation since month to month contracts give you more control of the property, especially with inherited tenants who we assume were not properly screened when placed.

You can bypass the custodian by using Checkbook IRA (aka IRA owned LLC), this structure will enable you to have checkbook control over your retirement account, but custodian will still be there holding your IRA with single asset, the LLC.

That did include ins and tax prepaids and recordng fees, closing fees that they do not control but still....Its not worth it to me to pay 10k on a 80k, especially with as little as I was going to make on the deal.

Now getting a foreclosure, that WILL ruin their credit.When you make arrangements with the homeowner, they have some control over what is going on, even if they don’t have the means financially to rectify them (this is where you come in) time to find a place that is within their means, and the money to do it with!
