I wouldn’t collect anymore rent from units if they had new impact resistant windows so it’s hard to justify the expense.

Secondarily, depending on the error, there may not be monetary damages available (or be very difficult to collect), and this may be the case if lawyers are suggesting the path of least resistance is to seek a variance to resolve the issue. 

Look for at least an 8 mil wearlayer and a scratch resistant finish preferably AO or  Ceramic Bead. 2.5 mm thickness is the least I'd recommend, preferring to stay with a 3mm or 4mm as they don't show irregularities in the  subfloor as easily.
