I suspect that if you tried this after a month, you would find a judge would rule that you acted in bad faith when signing the original contract and they may void it and/or award damages to your tenant.

I think is better idea just to ask the listing agent to contribute 1-2 % to the escrow.He make a lot bigger check and i am awarded for finding the property alone and call him for sure deal.Few days ago i find a good deal and decided to ask the listing agent to contribute 2 k to the deal.His immediate answer was- NO,this is illegal.

If they do not file an answer the judge hear can only grant the eviction but CANNOT grant a judgment in your favor as the defendant served never filed an answer or signed the document that they were served when the Marshall came out.The Marshall can mail and also tack on the door giving notice but if that person isn't there then you would have to bring another action in small claims court and win to get a judgment.Of the judgments that are awarded either in eviction court or in small claims only maybe 10 to 15% are collected on.

As long as you do nothing malicious they can't come after you for more than contract law which should be covered by your policy and the tenant's policy (make sure tenants have renters policy) I stated malice above because i am not aware of a policy that can protect you for punitive damages. ( awarded only in special cases, usually under tort law, where the defendant's conduct was egregiously insidious)John, any additional thoughts?
