Does anyone know if the Realtor lease can be amended so we do not have to change the form?  

Adding a buyer requires an amendment (change) to the contact that must be agreed to in writing by all parties (including the seller).In my experience, banks don't generally allow new buyers to be added to contracts without a *great* reason, and even then, generally not.

I am going to take a look at amending the offering circular to make it clear that it is a yearly fee. 

Smoking isn't that bad since it's not in the lease but be firm and see if you can amend it or amend it when it comes for renewal.
