most likely you have a mediation clause in the state contracts.. if you think you need to file fore mediation put up the money to do that.. many times in mediation you can reach an in between solution.

I've heard that small claim courts always try to push for mediation before going before a judge, which is something I can use to my advantage, because they haven't budged at all in negotiations, however it is my understanding that the requested $1,500 in legal fees might go up if we don't settle prior to.One more thing that is noteworthy is that they sued the management company (which I own) and not me directly (the property is under my name) and if this continues to trial they will need to re-submit the lawsuit.

Realtor listing of my house has been wiped out since filing complaint

[Had to quit my job in 2010 to care for husband ,hes had 4 strokes from then till now]Hes 68 ,I'm 62 and we are broke ,due to this deal.Realtor got a contract from local County Attorneys Office,filled in the blanks,told me I was going to make a ****-load of money off this deal.After 3 years I still receive $426.90 a month,lady has breached contract 3 times.I filed complaint 1 year ago with the KY Real estate Commission ,it has went through investigative faze and is now in mediation faze.Mean while all history of my house and length of time she listed it has been wiped out.Commission Attorney ask if I could get it.I have no clue how to get what is no longer there.Real estate lady is saying ,because we did not fill out another agreement ,she is not responsible for the bad Contract For Deed.Even though she signed as a Realtor/Broker.This is not a recovery of lost money ,but to call her into account for not protecting me in this deal.Its a sweet deal for the lady in my house.An Attorney I had to just look it over ,said nowhere in this contract was I protected.No balloon payments,she can pay me $426.90 till 2047,this must be when the ****-load is coming in.My husband and I will be dead .Any help on any of this?

And if all else fails in your conflict resolution plan, put in a mediation / arbitration kicker if things really go afoul.
