Even if they are "lending" money to you, as in a note of some type.. because the way your marketing or presenting it to them, you still are knee deep in SEC territory.

Problem is, the $50k higher offer pushed it out of short sale territory, and if the bank knew about it then they'd revoke the tentative short sale approval ASAP, meaning our law breaking listing agent would in retrospect have wasted all that time she did convincing the bank of "maximum" value.
