If  I   use rental financing (accepting the higher rate)  and then declare it as primary residence for  the 121  exclusion is that an issue- re the loan and potentially the case for the  121 with the IRS>    If i  refi my present home to gain the funds  then  there is the issue of jumping to the secondary residence and trying to declare as my  primary re: the loan?

The city  ‘declared’ the property abandoned and a nuisance and notified the bank (2nd mortgage was taken out and foreclosed) of its intent to demolish the property.

Read your documents thoroughly and answer the declaration questions truthfully.Most banks will ask you specifically "if any part of the down payment is borrowed".

I was approved for a loan for 350k and have around 18k for a downpayment, however, as I have been finding in the past year while I enhance my "deal analyzing" muscles, it's hard to find anything more than a 2 bedroom for under 400k - and I've really gotten in there - if by chance you do, it'll need thousands and thousands in repairs and we do not have the cash flow for that on top of the mortgage.
