The gamble is that the outcome hinges upon the courts discretion and it’s rare to see specific performance unless buyer can demonstrate that monetary damages aren’t enough to make them whole.

In the end we had to pay to turn the space back in to a white box/shell and closed with basically zero physical assets.

I had a few phone calls with Pricelabs, and their basic premise was pretty convincing:  "We are going to help you book your rental for as much as we can, as often as we can." 

Basically from the foundation up.

Basically they missed the loss to lease figure and would be breaking even in the first few years.

I could go on and on, but basically I would love to get any insight into how I should approach this opportunity.  

Now, I'm not an attorney, so I'm basically mansplaining something that I am not qualified to comment on.

Brian B does a little investigation to find out that this GP had basically zero experience in the space yet took down a 50 mil dollar apartment in Houston ( not sure how they talked lenders into that one) but there is 10 mil in investor money that got wiped out as Brian showed this investor that the property went to foreclosure and reverted to the bank ( no one bid it).

Since you can't control the sale price, you basically have a $4k cushion to your reno costs, or otherwise you lose money compared to the as-is scenario.
