Call your own attorney to get this matter quashed and show you won't just bend over and take it.Second, get your attorney, or possibly a new one, to amend your lease to include necessary hold harmless language as well as necessary wording about limitations on suing you, tenant agrees to reimburse you legal expenses etc.

Yeah it burn's to hit a good tenant with a late fee when they are down on their luck, but if you bend one rule, I suppose your inclined to bend more on a per situation basis which I do not want to get into that's for sure.

I'm just making the point that the mortgage is still high interest debt because the true / total interest is 67%, therefore prepaid principal is a great investment people should be bending over backwards to do.
