The capital gain, $100k, is taxed at capital gain rates.The $36,360 in depreciation recapture is added to and taxed as ordinary income (No ss/med tax) up to a max rate of 25%….since it was deducted from your ordinary income as you claimed it each year.

Insulate, add electrical, mini-split ac, and possibly plumbing, as desired, drywall, tape and paint, put built-in cab's on one side if you want, hang the tv, speakers, etc, install bi-fold/multi-fold doors on the side leading to a patio, and replace the garage door with an insulated one keeping the track and removing the motor, or install a carriage type garage door into the existing garage opening.

I planning to have backyard installed in new construction SFH.I read this cannot be added to the cost basis of the rental property and be depreciated by 27.5 years since it is not an improvement to the property.But what about paving the patio and side of the garage, where it is touching the house.

No reason to hydro jet if they are replacing , backfill and bed the pipe is not a line iten , its putting sand around the pipe 6 inches and filling in the trench . 8 ft isnt that deep , still need a trehch box , but nothing out of the ordinary .

I've seen some beautiful outdoor paths & patios done this way etc, fill in the gaps with sand or concrete.You might also donate it to a habitat for humanity store (call and ask if they'll take it first) where they might get it in front of the right set of eyes. they might give you a tax donation receipt?
