Unless you can see black mold in plain sight, can smell it everywhere, and the toxicology report confirms it is toxic mold, I would take such reports with a big grain of salt.

If you could have easily found out that it was historic and/or already did but ignored it and closed anyway, it might be a hard battle to win.If the seller says the roof is 5 years old and the home inspector says it's 15 and needs to be replaced soon, and you close anyway, would you expect to sue over the roof?

Whenever someone chooses to pay off their mortgage debt early the banks cry foul and impose a Pay Out Penalty based on the bank supposedly lending that same money at the Mythical Posted Mortgage Rate.
