Operating legally is definitely not a safeguard as I provided data to the city that was sufficient to demonstrate that it had operated legally at least the last 5 years (but it has operated legally 23 years) to get maximum STR lottery entries.Note this quota occurred after the council initially passed a ban on STRs all together and pulled the regulation when it qualified to go to ballot (council must have expected they would lose the ballot initiative why else pull it without having it go to vote).

. -- Routt County, where Steamboat Springs is, has totally banned them.-- A little further south from you, the counties and cities around Denver are a little tougher on short-term rentals. -- Clear Creek County and Gilpin County both have caps on the number of Airbnbs and have met those caps. -- Jefferson County technically allows them but a county board has discretion over renewals, and I know of people being denied for what seem like arbitrary reasons.-- A little further from you, Park County is a great option.

Yep, this.I see so many properties with our clients in Denver and the mountains that advertise as "great for an STR" or "is a successful Airbnb," but in fact that municipality bans non-owner occupied short-term rentals or I know the STR license doesn't transfer to any new owner.
