One thing beyond the normal assurances that is a "must have" as far as I'm concerned is that your QI should have segregated dual signatory FDIC insured accounts.

I suggest contacting the listing agent directly , have him/her place an offer as a dual agent (both buying and selling agent).Most agents would jump on that opportunity, because that means they can have two slices of the pie (as opposed to splitting 5-6% of the sale price with another agent).

If the you're interested in a home that happens to be on the MLS, another option is to write the offer through the listing agent (in a dual agency) and request that they rebate back a portion of their commission back to you to cover closing costs.Keep us posted!

The licensed real estate agents have a duty to make sure the parties rights are adhered to.The Listing Agent isn't subject to another commission, they have the contractual right to it, if it is so stated in the Seller signed Listing Agreement and they double end the transaction (represent both buyer and seller = dual agency, which can be very dangerous in a litigious society- but hey, liars need to earn a living too!)
