It's FL, no worrying about pipes freezing here.It sounds like your options are to leave them on and face the potential of being sued when you shut them off of the tenant, waiting 3 weeks for them to come up with more money and not having your unit rented or finding another tenant.

I understand that the refinancing would give me a new mortgage at fixed interest rate payable over 30 years while the HELOC has a variable rate, no draw after 10 years but I would start paying on the principal and conditions could change also freezing or calling the HELOC.

If it's in the area where the downspout is it could be moisture then freeze/thaw moving the bricks.These are all fixable but I'd get a good contractor (or an engineer) to look at it.
