I'm sure they'll be able to turn this into a $100k lawsuit with settlement that works for both of you.As @Dalton Elliott states, Lima One will try to enforce their policies regardless of your experience, their mistakes, or perhaps in the spirit of compromise.  

If it is below your property, I don't know that privacy is compromised.  

Even if it was built out of compliance with the codes at the time of work, you may very well be able to apply for a retroactive zoning variance, especially on the grounds of financial viability being compromised.
