Note: If the tenant chooses not to pay the rent increase he should continue to pay the regular rent and be prepared to pay the full amount of the rent increase if the court rules in the landlord’s favor.

Something else to keep in mind is a LLC does not provide absolute protection so you still need to take other measures to protect yourself like insurance, umbrella insurance policy, trusts to help further hide your identity, don't use your name and home address as the registered agent for the LLC.

I think if you have a regular homeonwer policy with enough liability coverage you should be good but definitely check with your insurance guy.

If you did Not do a 1031 at all, I don’t see where the concept of boot comes in.....you pay your regular cap gains and dereciation recapture just as if you never heard of a 1031, but only a year later, in your case, I believe.Where is that Dave guy anyway?
