I, like many of my colleagues tend to opt for the more conservative approach when analyzing tax legislation/litigation.

This is a long-term strategy for me as litigation can take years in some cases, but with a decent backlog of these types of foreclosures, especially commercial properties, it's well worth the time investment!

Normally folks in those price points simply dont have the money to fully litigate and no attorney is going to take it on contingency.. so you basically out spend them  and then you guys settle.

David, please talk with a lawyer about this, there may be criminal, ie SEC violations, or at least civil claim you can bring.

I have brokers in various states where vacation homes run into deductible issues, HOA reserve issues, litigation, just to name a few examples.

That is a very tough one to litigate and win, and IMHO it's better to walk and find another buyer.
