Typically when tenants pay for the background check they are committed to renting your property.While the background check fee might seem negligible to most people, it's more of a physiological sunk cost.

I don’t mind working with my brains, but working with my muscles is dangerous for me since I can not be sure how long I will have full control of my physiology.

Realistically they can leave any time, lease or no lease, maybe just physiologically they won't leave.
