I did not mean to imply that all government is bad, merely pointing out the hypocrisy of holding investors liable today for something that the city/county could have been working on for the last 40 years, but they did not take any action or accountability for the problem, they just let it fester.

Then YOU go after the roofer for being sloppy and not dragging a magnet broom around the property to pick up stray fasteners.Trying to hide behind some indemnification clause in a lease over a few bucks is just asking for this thing to fester and grow into a full-blown law suit.
