It depends on the laws of your state but I think you waived the right- now you have to wait for the next default and do not accept the rent- now if your state requires a mandated 3 day notice- pay or eviction- then you have to accept the rent during the notice period and that automatically cures the breach.If the tenant is month to month you can cancel that lease at any time in most states by complying with the statutory notice requirements.
