If the attorney doesn't do all these things (must file an affidavit that he/she did them), the service could be compromised.

Then you need to hold yourself to those standards and don't make compromises. 

Everyone wants to go hard ball process and procedure no compromise with contractors but the truth is that for a lot of us small business investors a couple hundred dollars to a tried and trustworthy member of your team will pay dividends ten fold over the course of your REI career.

If it is below your property, I don't know that privacy is compromised.  

Even if it was built out of compliance with the codes at the time of work, you may very well be able to apply for a retroactive zoning variance, especially on the grounds of financial viability being compromised.  

I told them there was no way in hell I was paying engineering fees to put back what was there, and we settled on a compromise wherein they let me put half walls up just under my construction license/bond.
