I'm not an attorney, but I would guess that it's perfectly legal -- HUD-1 settlement sheets (and the RESPA laws that would often govern things like this) are only required to come into play on deals where the buyer is using a government-backed form of financing.

I'm with Ned...never heard that term...That stated, "Replacement Cost" is a term relative to insurance that indicates coverage that allows for the recouping of depreciation in a claims settlement.

But, here is an issue, if the buyer is renting it out, he needs a tax number as he will have taxes due on business conducted here, so you should require a tax ID number as you'll need it at settlement showing it as a commercial loan.
