I'll leave the speculation where it should be -- out of the conversation -- because we can't know if this is an actual deed restriction, or an HOA amendment that can easily be re-voted on to extend it to 25%, or whatever.

The LLC does not need to be profitable at the time it joins the plan.If you setup the Solo 401(k) with just you as a sole proprietor today and added the LLC in the future, the plan would need to be amended to reflect that change and there is a cost associated with such an amendment.

I do hope the state amends the rules and requires a LOT of disclosures for agents calling themselves "wholesalers" because I believe they are not acting in the interests of the seller.
