That complicates enough I'd consult with an entity/asset protection pro.I don't hold residential assets in LLCs unless partners got involved.

Whether it's considered an arm's length transaction is debatable, but it's not illegal.Move forward with the sale and ensure full transparency with all involved parties, including your CPA.

@Anthony Chan If you underreported depreciation on your rental condo, Form 3115 (Change in Accounting Method) allows you to claim all missed depreciation in the year of sale without amending past returns.

The LLC can sign an agreement with the debtor (mortgagor, that’s YOU) accepting liability for the debt, but that’s only between the two parties involved in the agreement.
