If you are not making payments, those "loans" will be disregarded by any court.

I always suggest that clients have a single operating LLC, and then disregarded entities for each property, of which the operating LLC is the sole member.

One holds our rental properties and is simply a disregarded entity, the other is for a different business and is taxed as an S corp, so I have practical experience with the differences.

@Lynn Maher  I would suggest to disregard starting bid amount.It's not relevant.You should calculate what is the highest and best you willing to pay for this property.Depends on with county the auction located, another factor to take into consideration if the bid is PROXY or highest & best.

In many states, including here in FL there are exemptions from transfer tax when moving from a single entity LLC into an individual name because the single entity single asset LLC is disregarded.
