Many "deals" that happen on the courthouse steps are for a small first mortgage, but there is no equity in the property once taxes, liens, judgements, 2nd & 3rd mortgages come in to play.

I'm fine with combing the market for deals, just trying to find a way to legally secure financing without a due on sale clause raining on my parade.

I have rescued a bunch of those investors in my day.I get the sub too attraction I just think those sellers with stellar credit that want to keep their stellar credit take a very big risk giving title away to an asset that they are on the hook credit wise for ... and especially in default judgement states..

No one was active and now they are raining down on BP like hell is on fire because someone said it didn't seem legit? 

They also parked their large truck behind the building overnight when it rained and it got stuck on top of the water/sewage lines coming out of the building.

Recently with the heavy rain we have been getting a small stain appears on two of the ceiling tiles during the rain storms.

The court date is the 22nd and I might get a default judgement if they are a no show.So the real question is what to expect from Xcel.

Do the seller finance buyers then get a judgement against you for the money they've already paid? 

Considering this tenant is most probably judgement proof, who would you go after in this situation?

However, if you want to go after the balance and you have an eviction judgement from the court, you can higher an attorney to find legal means of collections, such as garnishment.
