This is an obvious fair housing law violation because you are choosing which prospect get the concession.

If you are a legal property manager in your state the owner should have the unfettered ability to allow you to act as his/her agent to enforce the lease, whatever provisions they may contain plus whatever your state laws allow.

This will allow you to get the sheriff involved immediately.If you are already past the notice period then you will probably have to follow whatever state laws are in place for the notification period and possibly the eviction process.

Follow the lease and the laws in your state and start the eviction process.

I think if you can nail that down you will be able to find a market easier.As a buy and hold investor some of the things that were important to me when deciding on a market were landlord tenant laws, price to rent ratio, housing demand, ability to build a team, large population 500K plus, multi-family availability and some other factors.take the process step by step and you will be fine. 

You need to know the appeal laws where you are.
