Via email, I asked him for the status of the mortgage denial letter, and he said he had requested one and would pass it on as soon as he received it.I told my attorney I would be receiving the denial letter, and after he spoke with the seller's attorney he informed me that the contract would be terminated upon receiving the mortgage denial letter and that it was not necessary to go thru with the inspection.Monday 12/19, my attorney and realtor are pressing for the mortgage denial letter.

So, here's your problem (and what a nice problem to have) - I think you'd be hard pressed to 1031 into anything that improved your roi on your current property.  

First, lookup Fair Housing Regs and maybe there's a State version too (there is in Calif).Try the Nolo Press books for Landlords and its parallel for Tenants.

At this point to not make any demands of repairs, it will seem retaliatory and will make them want to press the issue to get a new tenant.  

Is this a good idea or should I press for gas heating?
