Well in my leases I have a clause that the tenant must have heat and electric on at all times but likely the company wouldn't shut them off until April because they can't turn services off in cold weather in this area and then if they were to get shut off, I'd just issue a notice to comply.

Board of directors decided that as of this year all Investor Owners are required to provide a provisional copy of any lease to determine whether or not it complies with the Master Deed as it is written with regard to the leasing of units.

The 1031 co won't care about these issues as they must comply with the IRS CODE which to my knowledge have no provisions for such issues.

The County Building Standard Department here in Ohio mentioned that since we are changing the usage of the property from a residential to R4 (6 to 17 beds), we have no choice but to comply with today's standard, and the property cannot be grandfathered.

If you choose not to accept payment the only way you'd collect is to apply security deposit toward unpaid rent, and then file for unpaid rent in small claims court.In my opinion I'd accept rent at mediation if it was correct payment type and work out something if you want them gone do a settlement agreement, Mutual termination with payment plan until vacated date, get the writ so if they don't comply  you can go forward with the sheriff.
