I'm asking a question about industry structures.You are implying brokers are worth those rates, but that statement misunderstands the nature of my question.  

Maybe I’m misunderstanding something here....You want to put the deal together and instead of a fee from the Seller you want a second lien note on the property?

The lease is definitely a contract and is enforceable, but it is also a guideline for how certain situations will be handled.It sounds like you're the one who has a misunderstanding of the lease, Tenant-Landlord law, and related legal concepts and norms.

My take is there is a disconnect or misunderstanding there somewhere.

I could be misunderstanding and you are simply putting the money back in when you don't have to. 

I also find a trail from his property to mine, in a place there ought to be no misunderstanding, where he has been dumping trash.

However, I feel like I may be misunderstanding how it works.
