Perhaps you can show & prove to state they will actually make more money in property taxes if you develop the property and an amendment that you agree to pay at a minimum the current property taxes of the property as-is?

If there is any way to extend escrow and amend your financing, I would go that route, if not, you will be stuck with the expense of the HML and then the refi to conventional down the road and you will need to find a conventional lender without seasoning requirements.
