That could be true, but is highly unlikely.Much more likely is that you've signed and "exclusive right to rent", which doesn't prohibit you from marketing your own rental, but does mean that a commission is due to your agent regardless of who brings the tenant.Finally, many have commented that they think that asking the tenant to pay the real estate commission is silly and may be damaging your chances of finding a renter.This is a case where different markets have different practices.

I wasn't going to make an insurance claim, because I don't think the other damage will go over the deductible, but I changed my mind on that, so we will see what insurance has to say about the whole thing.
