If something has been sitting on the market for too long, odds are that the price is too high and/or there are some other undesirable features with that unit.Once I find comparable listings, I'll usually put them into a spreadsheet and look for patterns, this lets be go back and look at what other people posted once the listings are removed.

So while yes any buyer should obtain title insurance especially when confronted with a fact pattern that includes several intra-family transfers, deaths and so forth, unfortunately once a problem like this is discovered, title insurance is not available.The conveyance by D severed the C/D joint tenancy and created a 50% t/c interest for C that has not been accounted for through several transfers over 40 years.

They may, of course, subject you to collection action but that can be quelled in its tracks by gently reminding them that the FCBA allows for an award of damages plus twice the amount of any finance charges - or higher amounts (unlimited liability) if a pattern or practice of violations is established.
