EM is major pain when the parties dont agree.. and its mainly emotional anyway.. and as stated usually small dollars.. out here my attorney is 450 an hour.. how are we going to have them rattle a cage for a 500 or 1000 refund.. 

Never threaten a law suit that you don't follow through with, let your attorney rattle the sabers.

I know it's easy to rattle off the keyboard and not have to look someone face-to-face as they try to throw out "false" information. 

And you might say well you were unlucky and that was your anecdotal experience .. true.. however, I can quickly rattle off another 6 builds with different builders, all with similar experiences.  

They will see they have you rattled.

I also try to inform their attorney ahead of time or accountant, being that "up front" with those who advise them will get you much further than some attorney calling after the fact and rattling his saber at you for taking advantage of HIS client!

The thing that is rattling around in my head is how flexible this 50% rule is.What I mean is, does the rule apply to the 1% rule, the 2% rule?
