Where there is no contract for rent, there is no real chance of a small claims (or a civil suite) awarding you back rent (unless the squatter is really a tenant who is overholding).  

I don’t think I would ever collect the damages awarded through arbitration (which is what our contract requires to resolve billing disputes).  

However, if I was to do that I would need something in the contract for me to back out of the situation if I was not awarded the property.

One relevant question: In the event the third party prevails against your seller, would any judgments/awards attach to the property by some legal mechanism, after you bought it, or would it be just personally against the then previous owner?
