Under the same condition you hire a RE lawyer and innocent or guilty your going to have a crying wife, a ruined year, and even possible health problems from the degree of injustice felt, plus the degree of insult from being a victim of this carefully engineered theft. 

To a degree it's not the agent's job to educate on investing.

I would like the tenants to still be able to change the temp on the unit but not go above 72 degrees in the winter and 68 in the summer. 

That said, the senior lien going into default would erode that appreciation to some degree.
