If that's the case, the OP may not be committing fraud, but the lender is.The only way it may not be fraud is if it's a portfolio loan (not insured by any external institution), in which case I would argue it's not really an OO loan if the lender says you don't have to be an OO (by definition).

As for the hoa fee (which covers external and common area maintenance) it is an expense not normally figured in the 50% rule, so in theory you need to subtract that after the 50%, but on the other hand you will avoid external maintenance which is part of the 50% so ....hmm.
