Most consumers don't fully understand the difficulties with conflict of interest or liability an agent takes on with this type of agency agreement, and expect all agents to have a fiduciary duty to them (transaction brokers aren't supposed to advise or have a fiduciary duty to either party, and dual agency is illegal in many places due to the unavoidable conflict of interest of serving two masters).
