I've never had to test it in court, but in my eyes, you have legal justification to keep a fee paid to you, because you fulfilled your end of the agreement and held the property for them.

If all three of your properties are investment properties, you would be eligible to purchase a home (SFR up to a 4-unit) as your primary home with an FHA loan.There is no need to “adjust the mtg to make it an investment property”….after you have fulfilled the one year occupancy requirement you are free to move out, convert it to a rental, and buy another primary residence, with an owner occupied loan.There are however other issues…the lender has to be convinced you will actually move from a sfr to multi unit.
