You appear to be a property manager so I'm willing to bet you follow this same process.You appear to live in Pennsylvania so I will tell you what your state law says: Prepaid Rent: A landlord is only allowed to collect up to 2 month’s rent for escrow purposes, 1 month’s rent during any subsequent years. (68 P.S. §§250.511a.)A recent ruling in PA makes clear that it doesn't matter if you call it prepaid rent or last month's rent or security deposit.

I started compiling a list of private lenders by going to the county recorder's office, looking at the 1st page of the deeds of trust that were recorded, and writing down the name and address of anything that appeared to be a non-bank in the section "When recorded, mail to:" It was tedious and took me about 4 hours to compile 50 names.

if he is paying it off he should have removed that from title.. as he ( your attorney who closed it paid it off)  Look at your title policy and see if that deed still appears.. in most states banks have 30 days or so to record the satisfaction.. you don't just get a letter from the lender.. there is a recorded document so its know to the whole world.. your buyer though is being picky.. unless he is also flipping it or his lender requires it before they will fund.
