Are you concerned he will spend the money on new hairdos for his wife and new bicycles for his children versus putting it into a fiduciary account and applying it to the rental as it comes due ?

If they pay off the first mortgage and the lien and I take any cash left over I'm concerned that's going to be a hefty mortgage payment and higher balance.

@Basit Siddiqi yes I’m a little concerned, so I checked with the CPA and the response is “the loss is non-passive because that is how it is reported in the K-1”.

I'm looking into multifamily (duplex & self landlording) in my local area to get started, but my tri-state area (CT/NY/NJ) has a high entry price point that I'm concerned with over leveraging myself and losing liquidity on my first deal. 

Not that it's anyone's concern, but what we're dealing with is certain people trying to push investors, LTR, MTR, STR, out of an HOA.

I am concerned on spending 25K plus on appraisals and inspections just to have someone blow this up at closing.Is there any document I can get signed that could prevent this from happening?
