The lender/holder of the deed of trust (the beneficiary) could substitute themselves in as trustee, and conduct the sale.

Seems like a legal catch 22.I don't think substitute trustees are held to the same standard as mortgage servicers/lenders.

In Fairfax County, a bidder's deposit of 10% of sale price or 10% of original principal balance of subject deed of trust, whichever is lower, is required day of auction in the form of cash or certified funds payable to the Substitute Trustee present at sale.

You want to search at your county for the Notice of Trustee's sale, Substitute Trustee's Sale, or Substitute Trustee's Notice of Foreclosure sale.

You can read all the books and watch all the podcasts you want but there's no substitution for just hitting the pavement and working what you've learned.   

Not likely they'll allow the plaintiff to substitute publication.
