I did find that the CDC completely overstepped its authority and ordered a blanket national moratorium on evictions until December 31, but at this point, I still had not received any official CDC Declaration from my tenant.So I responded that he's made no effort to pay or to provide evidence that he will pay and that I would be filing the unlawful detainer the next day.

However, it only applies under certain circumstances and even then ONLY if the tenant submits a signed declaration to you under penalty of perjury (which I'm guessing they haven't done since it doesn't sound like they even know about it).

If you rented the property to friends and family (declared the income on your tax return for 2020, had leases collected money even if you give the money back as legal gifts) then that is an investment property and would be eligible for 1031 treatment.It's all about the intent and how you demonstrate that intent.
