Every 6 months we have to print out a "short form standing" letter from the state and send it to our hard money lender to let them know the LLC is still an active business.

If the investor needs more security before investing, attempt to find a tenant who can agree to lease for higher end amount based on comps once the repairs are done, then sell 1/2 to investor now that you have Letter of Intent from tenant. 

If you were to not find a suitable replacement property then your smart move would be to not turn in a 45 day letter and simply pay the tax. 

If there isn't the language , let tenant know there will be a letter in the mail which they must comply and sign.
