I think it depends on state law and where they are incorporated to determine how warranties are handled with acquisitions.

Instead of trying to persuade people to invest with me in real estate, I'm thinking that I should just argue that investing in the 506(c) is very similar to investing in corporate bonds.

Both parties need to be in the loop; if I were a Buyer in this situation, I would make sure everything is incorporated in the sales agreement and all parties sign off.
