If the property has more than the 21 units, which are owned by others, where you are only buying the developers or an investors unconverted units then this is a defective condo conversion.

Also make sure to get contractors liability coverage, as you could now have a product defect claim for up to 8 years (I believe that is the statute of repose in CA)

A few other reasons that people look at this time of year (and that I would consider as acceptable): need bigger place (expecting a child or having another relative move in with them); want smaller place (kids moved out); relocating for change of job; house they are in has been damaged (fire, storm, mold, structural defect, etc).I'd also consider anybody whose lease has expired where that lease was not month-to-month.Most other people moving now and in a hurry are desperate to get out before the eviction is completed ...

You're paying for your attorney's advice based on his judgment, knowledge of actions as welll as statues.Selling "as is" is not always a get out of responsibility card, hidden defects is one thing, known and not disclosed could still be fraud.So yes, listen to your attorney,IMO.

Hire GC/subs with liability, work comp, commercial auto policies; should include coverage for "projects and completed operations" to cover my cost to bring the property to completion if faulty workmanship, defective materials, carelessness, or accident occurs; covers defects after property is sold; should also cover theft of materials/tools so I'm not out the cost of a stolen pile of 2 x 4s (they buy everything).Questions: Is "Hazard" insurance for fire, wind damage, vandalism, etc. covered in vacant building coverage?

Tenant’s Maintenance ResponsibilitiesTenant will: (1) keep the premises clean, sanitary, and in good condition and, upon termination of the tenancy, return the premises to Landlord in a condition identical to that which existed when Tenant took occupancy, except for ordinary wear and tear: (2) immediately notify Landlord of any defects or dangerous conditions in and about the premises of which Tenant becomes aware: and (3) reimburse Landlord, on demand by Landlord, for the cost of any repairs to the premises damaged by Tenant or Tenant’s guests or business invitees through misuse or neglect.

That our company would take into consideration any defects as part of the walk through and this walk through needs to be scheduled for this weekend, April 1st.My intention is to collect the April rent when meeting the tenant for the walk through on April 1st, the tenant has not been responsive and I think that I will have some problems collecting the rent.
