If you wanted to earn money you would either need to work out a deal with the agent to pay you part of her commission (may or may not be legal in your state) or go to the seller directly and work something out with him (he may or may not have signed a document awarding his agent the 5% no matter who sells the property)Most wholesalers I know do not bother with the MLS.

At court ask the judge to award you the amount of your rent + $100 for each month that the landlord fails to provide the information and your costs (likely around $50 -sorry no Attorney's fees in small claims court).
