Work with a real estate attorney to draft a formal agreement that outlines responsibilities and protects both parties. 

It sounds like the tenant has solid evidence their check or auto payment was received by the wrong party.  

This will avoid the asset having to go through probate and any 3rd party (family) related issues.3.

Ordinarily those tenant vacated damages would be too remote, but it sounds like they were contemplated by both parties at the time of contract.Were I in this situation I would be looking to state law to determine if the EMD is truly the extent of my potential liability as a buyer. 

Everyone thinks the cost of 3rd party PM relates to fees. 

This party won’t last forever, no one tells you when to get out, sometimes you realize too late.
